How prices are formed for visiting children's educational institutions

Kindergarten Compensation Law

The opportunity to receive partial compensation for the maintenance of a child in a kindergarten is regulated by Part 5 of Art. 65 of the Federal Law No. 273-FZ of December 29, 2012 " About education in Russian Federation ».

  • 50% - for the second;

Compensations are listed to the bank account (passbook or card) of the parent who paid for Kindergarten, monthly until a certain date established by regional law. It is impossible for parents to pay for the kindergarten with the simultaneous deduction of compensation, that is, first they must pay (and on time) the full amount, and then receive the due compensation.

Compensation amount proportional to several factors:

  • the number of children in the family up to 18 or up to 23 years old (the latter - when teaching a child in a full-time department);
  • the actual cost of services of a preschool educational institution;
  • established benefits at the regional and federal levels (for example, depending on family income, number of children, their health status and other circumstances).

Kindergarten reimbursement application

One of the parents or guardian of the child can apply for a refund of the kindergarten fee, with whom the contract for a visit children's institution. As a rule, an application is filled out on a special form of a preschool educational organization, a possible sample of which is given below.

  • the name of the preschool institution to which the applicant is applying;
  • Name and place of residence of the parent;
  • the content of the application with a request to provide partial compensation of the parental fee for the child;
  • list of attached documents;

The application is submitted to the educational organization in which the child was admitted, in the name of his head. After acceptance, it is registered in the register of persons who applied for payment compensation.

The applicant, together with the application, must also provide (in originals and copies) the following documents:

  • identity card (passport);
  • birth certificates of all children in the family (if compensation is issued for the second and subsequent children);
  • data on the bank account number and details of the credit institution for transferring money (usually indicated on the cover page of the passbook or on a certificate from the bank on account details).

The subsequent procedure for considering the application and making a decision takes place in accordance with the legislative acts of specific subjects of the Russian Federation and municipalities.

As a rule, an authorized representative of an organization implementing a preschool educational program, when accepting an application:

  • certifies copies of documents, and returns the originals to the applicant;
  • forms and submits to the authorized body (for example, the Department of Education, Social Protection and Health) lists of applicants for compensation;
  • quarterly updates these lists and sends to the authorized body data on the actual payment made by parents for the cost of visiting a kindergarten by a child.

Compensation payments for kindergarten are made based on the funds provided for these purposes. regional and local budgets.

An example of calculating the amount of compensation payment for a kindergarten

Suppose that for a family with children 3.5 and 5 years old, living in Petrozavodsk, the fee for attending a kindergarten is 3410 rubles. per month (for each child). When applying for compensation, parents will be reimbursed on a monthly basis:

  • 682 rub.(20%) - for the first child;
  • 1705 rub.(50%) - on the second 50%.

Compensation for not providing kindergarten

As mentioned above, the law "On Education in the Russian Federation" the right of citizens to free children's preschool education. Several years ago, they tried to solve this problem at the federal level by amending and amending the law “On Education” that was then in force with the help of the project draft law No. 556611-5, which in the end was never adopted, but the measures proposed in it to support families with children are still very relevant.

In 2011, a draft law No. 556611-5 was submitted to the State Duma, which provided for changes to the law "On education", which was in force even before the adoption of a new similar law No. 273-FZ of December 29, 2012.

The document suggested at the federal level resolve the issue of providing cash benefits and compensation payments to parents who cannot get a place for their children in a state or municipal preschool institution. The socially useful draft law was rejected due to the huge queues for kindergartens in the regions and the potential inability of the federal budget to cope with a possible influx of people seeking compensation.

At the same time, it must be understood that the unwillingness of the state to take care of preschoolers often leads to deterioration child care conditions. For example, in non-state "trust groups", where parents are forced to leave their children because of the need to go to work in the absence of places for children in kindergartens, sanitary and living conditions are violated.

Compensation for the absence of a place in a kindergarten in the regions

At the moment, in some subjects of the Russian Federation there are local compensation payments parents of children who are not provided with a place in kindergartens or nurseries. Amount of monthly compensation not unified, is established taking into account the possibilities of local budgets, and the conditions for obtaining (in particular, the age of children giving the right to compensation) may differ significantly.

In most regions, such assistance is provided for children aged 1.5 to 6 years, however, in each specific case, the emphasis on the problem can be put in its own way:

  • in Lipetsk, it is provided for children from 3 to 6 years old;
  • in Samara, Kirov, Krasnodar - from 1.5 to 3 years.

In some regions, regardless of the age of children, the amount is unified (Arkhangelsk, Tomsk), while in other settlements it can be set differently. For example, in 2014:

  • in Perm, compensation for children 1.5-3 years old was 5295 rubles, and for children aged 3-6 years - 4490 rubles;
  • in Samara, 1,000 rubles are compensated for the first child, 1,500 rubles for the second, and 2,000 rubles for the third.

With various variations, similar benefits and compensation are also established in Lipetsk, Yaroslavl, Yamalo-Nenets and Khanty-Mansi Autonomous Okrug, Smolensk Region and other regions.

The official list of regions in which the program is currently operating , does not exist. You can find out whether monetary compensation is relevant for a particular locality of the Russian Federation at the social security authorities at the place of residence. However, there is a problem of informing employees of local social protection authorities, who often cannot provide the necessary information to parents. In such a case, a request should be made to the Department of Education.

  • applicant's passport;
  • certificate of marriage (divorce) of the parents;
  • number and details of his bank account;
  • birth certificates of all minor children;

  • an order to provide the mother with maternity leave from the place of work (or a work book for the unemployed);
  • information about the composition of the family;
  • medical policy for mother and child.

It must also be remembered that regional compensations and benefits are established in the subjects of the federation exclusively on their own initiative- there is no law binding them at the federal level yet!

According to parents, this kind of compensation and benefits are very significant for families with children. The absence of a federal law-regulator that would make such payments mandatory for any subject of the Russian Federation puts parents from different regions in a very unequal position.

The ability to return money for paying for kindergarten is provided for by the legislation of the Russian Federation. The Federal Law states that any family has the right to compensation for kindergarten fees. Who is eligible for a refund

Any of the parents (or guardians) who has entered into an agreement with the kindergarten and carries out payment for visiting child. In addition, the amount of compensation for paying for kindergarten for parents belonging to certain preferential categories is legally established. Citizens of these categories can count on compensation in the amount of 50% of the amount that must be paid for visiting the kindergarten. This compensation is considered a separate benefit and affects not only the amount of money returned, but also the order in which children are admitted to kindergarten.

Since 2016, 13% of the tax (personal income tax) has ceased to be withheld from the compensation paid. This is a small amount in relation to the interest paid, but this fact may be relevant for parents who receive compensation for several children attending kindergarten at once.

Documents for a refund for kindergarten

Recall that the state can return money only to the parent in whose name the contract with the kindergarten is concluded. To apply for compensation, you must collect a package of documents, which includes:

  • an application, the sample of which can be determined by each preschool educational institution separately (its form is not approved by law);
  • a copy of the parent's passport (in the case of a guardian, it is also necessary to attach documents confirming guardianship);
  • data on the applicant's marital status: certificate of family composition and copies of birth certificates of children attending kindergarten;
  • bank account details to which compensation will be charged.

In some regions, it is additionally required to provide a certificate of being in line at a preschool educational institution, an order for maternity leave and other papers. A complete list of documents must be clarified in a specific preschool educational institution with which an agreement was concluded with the parents, or in the social authorities. protection if the parents' application for compensation is denied by the county.

The package of documents must be given to the head of the kindergarten, while the date of receipt of documents is recorded in a special journal. The safety of each document is under the responsibility of the DOW.

Since 2019, after certification of all documents, the administration of the preschool educational institution can redirect the parent to submit documents to local authorities or social services. protection. How to correctly calculate the amount of compensation

Calculation the amount of compensation occurs depending on the number of children in the family, and a partial refund is calculated from the amount of the parental payment for the maintenance of the child as a whole - for food, a place in the kindergarten, additional educational services (if any), etc.

The percentage of compensation depends on the total number of children in the family, regardless of how many of them attend kindergarten. Compensation percentages are as follows:

  • first child - 20%;
  • second child - 50%;
  • third and subsequent children - 70%.

In addition to the number of children in the family, in compensation is played by the average parental payment of preschool educational institutions of this category in a particular region. This is especially true for private kindergartens, in which payment compensation occurs precisely in relation to this amount, and not to the fee established by the contract.

It should be noted that the amount of parental payment - this does not have to be a monthly fee set by the kindergarten. Interest is deducted from the actual amount spent by the parent. For example, if out of 23 working days of the month the child visits only 20, then the actual payment decreases according to the missed days - which means that the compensation also becomes smaller.

Important! Although regions have the right to set the amount and limits of the compensation paid, according to federal law, its amount cannot be less than 20% of the average parental payment of a preschool educational institution of this category in a particular region.

How is the refund for kindergarten

The decision to pay compensation is not made by the administration of the kindergarten, but higher authorities. The procedure for issuing compensation may be different in each region of the country, depending on the formed legislative acts on this issue. Documents submitted to the kindergarten manager go through the following processing algorithm before becoming the basis for payment of compensation:

  • copies of all submitted documents are verified with the originals and certified by the seal of the DOW, after which the originals are returned to the applicant;
  • information from the submitted documents forms the basis of the generated lists, which the administration of the preschool educational institution transmits every quarter to the district administration, social protection and education.

In case of refusal of the district administration to accept the application, the applicant applies to the social authorities. protection with the same package of documents, attaching to it an agreement with a preschool educational institution and copies of receipts for payment for educational services.

The payment is made by the preschool educational institution itself through the accounting department. However, you will have to confirm your right to receive compensation every quarter - i.e. constantly provide the specified package of documents to the head of the preschool educational institution. Parents may have difficulty in returning part of the money for private kindergarten. The law states that material support is provided only to visitors of state and municipal educational institutions.

However, the right to receive compensation is still granted to clients of private gardens. True, its calculation does not come from the actual payment established by the contract, but from the average cost of a preschool educational institution of this category in the region. For example, if a private kindergarten belongs to the second category, then the parental payment for compensation will be calculated relative to the average cost of visiting a state preschool educational institution of the second category, and not for the entire month, but for the number of days the pupil visited.

In private preschools, the contract provides for a refund for the days when the child is absent from the group - for example, a refund for meals or for a place. However, the regulation of this issue is entirely under the responsibility of the administration of the institution, which establishes such norms independently. All the nuances of payments are spelled out in the contract concluded with the institution.

Thus, kindergarten attendance reimbursement can provide significant financial assistance to parents with multiple children attending kindergarten. The very procedure for issuing such compensation does not require the collection of a large amount of paperwork, but its conditions largely depend on regional laws.

Not all families have the time and resources to raise a child at home, but quite the contrary, in connection with which many children start attending kindergarten after a year and a half, as parents need to go to work and find additional funds to support the crumbs.

However, there are not enough places in kindergartens for all children, so parents have to solve the issue of caring for the baby with the help of grandmothers and the norms of the law.

Who is eligible for a place in kindergarten?

In accordance with Article 43 of the Constitution of the Russian Federation, every resident of the Russian Federation is guaranteed access to preschool education, and from a very early age, because on the basis of Article 67 of Federal Law No. 273, a child can be placed in a kindergarten from the age of 2 months, of course, if this rule enshrined in the Charter of the preschool educational institution, although many kindergartens prefer to accept children no earlier than two years of age.

Also, given that children are the future of the state, at the legislative level, a procedure has been developed for enrolling children in preschool educational institutions, approved by Order of the Ministry of Education of the Russian Federation No. 293, according to which all children from the moment of birth subject to registration to the department of education at the place of residence in order to rationally allocate places in kindergartens.

The stipulated Order says that for starters, children are only registered, and when they reach the required age and submit an application from parents asking for a place, a referral is issued to a preschool educational institution, which has a free place and is located at the place of residence of the child.

Of course, taking into account the norms of Article 6 of the Federal Law No. 124, a place in kindergarten should be provided to everyone, but first of all, in the lists of preschoolers beneficiaries are included, in particular:

But the rest of the children are given a place in the garden only if it is free, as stated in clause 7 of Order No. 293, and even then during the year. As a rule, earlier pre-school education was provided only at the state level, now educational activities commercial institutions can also, but only if they have a license in accordance with Article 12 of the Federal Law No. 99, which means that payment for the services provided may vary. It is for this purpose that the child care allowance and set the amount of payment for services, which, in accordance with Article 65 of the Federal Law No. 273, is considered the maximum.

In particular, in Order No. 862 maximum size set payment for kindergarten, namely:

  • with a reduced shift from 70 to 80 rubles for children from 2 months to 7 years;
  • with a full shift from 90 to 100 rubles for children of the same age.

Based on Article 65 of Federal Law No. 273 at the regional level, local governments have the right to set their own amount of payment for the services of an educational organization in the region, but not more than the maximum established by the state. That is, parents will not pay more than 100 rubles a day even in a private kindergarten.

Also, in accordance with part 5 of article 65 of the Federal Law No. 273, parents or legal representatives of the child are also provided entitlement to reimbursement of part of the costs for payment of educational services:

  • in the presence of one child in the amount of 20%;
  • in the presence of 2 children in the amount of 50%;
  • 70% if there are 3 children or more.

And the stipulated norm states that this compensation is paid to all parents without exception, however at the local level self-government bodies have the right to establish additional benefits to increase the amount of compensation, that is, for privileged categories, the amount of compensation can be increased at the expense of local budgets, which more needy families can already determine on the spot.

They also have this right individual industries on the balance sheet of which are educational institutions. In particular, Order No. 862 of the Ministry of Defense of the Russian Federation establishes a list of additional benefits for children of military personnel, and also defines a privileged category of parents who are entitled to compensation of 50%, regardless of the number of children.

Registration procedure

To apply for compensation, one of the parents submits the above package of documents along with the originals, so that the employees of the preschool educational institution verify the authenticity of the data provided and certify the received copies with the seal of the preschool educational institution.

Then the documents received from several parents are drawn up in a list, attached to the cover letter and sent to the Department of Education and the Office of Social Protection. And quarterly, the Educational Institution makes adjustments, updates the lists and reports on the transferred funds in relation to all persons who received compensation.

Payments for lack of places in kindergartens

However, not all children can be admitted to kindergarten, despite the guarantees of public access to education, many of them may simply not have enough places, which is actually happening at the present time. And although the draft law on amending Federal Law No. 273 on providing compensation to parents who are forced to renew maternity leave In view of the lack of free space, it was created back in 2011, it was never approved at the federal level. Although the subjects of the Russian Federation were given the right to establish this type of compensation at the regional level.

In particular, this type of compensation was established in many districts for mothers who are raising children from a year and a half to 6 years old in the amount of 1,000 to 6,000 rubles. But after several years and a significant amount spent, legislators at the local level decided that it was more expedient to raise age limit in kindergartens and not pay compensation, thus solving the problem of lack of places. To whom is it due

As a rule, when this type of compensation is established, it is paid to parents who have children registered with the education department and who have not received a free place in kindergarten. That is, as such, preferential categories are not provided, given that the beneficiaries have the primary right to receive places in the preschool educational institution.

But the fact is that even beneficiaries in kindergartens are divided into three categories, that is, the same children with disabilities, orphans or wards will receive places in the first place, but the children of single mothers or non-working students, from low-income and large families, and kindergarten workers will be assigned to the second stage.

And, accordingly, children whose older brothers are already enrolled in this Educational Institution will belong to the third stage, not to mention all other children whose parents do not belong to any preferential category, except that they are parents on parental leave . That is, in fact, all parents who were officially denied due to lack of vacant places can apply for compensation.

Registration procedure

In order to receive compensation, you must first contact the Department of Education with an official letter about the existence of a program under which compensation is provided. In particular, on the basis of Article 6 of the Federal Law No. 124, a place in kindergarten should be provided to everyone, and parents, as the legal representatives of the child, have the right to choose the educational institution themselves. That is, if in preschool there are no vacant places at the place of residence, the parent has the right to apply on the basis of clause 5 of Order No. 293 with a request for a place in another kindergarten, but in the same locality. That is, it is possible to enroll a child in another kindergarten temporarily until a place for the child is vacated at the place of residence, and then, on the basis of an application, make a transfer.

As follows from the above, at the moment, parents of preschoolers are provided two types of compensation:


On the basis of Article 65 of the Federal Law No. 273, compensation for babysitting applies to all parents, and all educational institutions are required to pay it, regardless of the form of ownership, that is, private kindergartens are required to return part of the money from the parental fee in the same way as public ones.

But the conditions for paying compensation for the lack of vacancies in educational institutions provides for the payment of this compensation only in respect of those children who were registered and applied for a place in a preschool educational institution that is state or budgetary institutions. By the way, if parents doubt the legitimacy of refusing a free place, they have every right to apply for legal protection to the prosecutor's office.

Possible changes and news in this issue

Of course, the educational system is not perfect, especially in light of the population explosion after a long recession, which actually provoked real problems of lack of vacancies.

A bill is also being developed under the patronage of the President to provide educational services at home, as well as the organization of small groups of pre-school education at schools, thus increasing the potential to provide pre-school education to more children.

I would like to note one more benefit established at the legislative level, in particular, compensation received for kindergarten from 2016 will no longer be taxed, which previously provided for 13% deductions from all amounts received.
