The moral essence of a person is most clearly manifested in the most ordinary situations: should I give way to an elderly person in transport, or help a sick person cross the road? To draw attention to this problem, the author describes one of the cases in the clinic: the main character, Nikitin, after standing in line for a doctor's appointment for some time, decided to bypass the others. To skip the line, he decided to give money (bribe) to the woman from the reception. At that moment, he thought only of himself and his hand. But when Nikitin looked at the others in that long line, he couldn't do it. Especially on his sympathy was the boy who trustingly buried himself at his feet. Is it permissible to put your interests above the interests of other people, what are the consequences of such behavior for a person? The problem of conscience is one of the problems raised in the text of the modern Russian writer K. Akulinin.
In our time, especially in big cities, people often do not take into account the interests and needs of others at all, they go through life pushing those around them with their elbows. The author refers to a seemingly minor case that occurred in an ordinary district hospital in a regional city: Nikitin stood in line for a long time to see a doctor who, for some reason, did not start an appointment, and, tired of the pain that tormented him, decided to bribe a nurse in order to get through to see a doctor without waiting. However, something did not allow the hero to use the dishonestly obtained privilege. The nurse calls him twice to take him to the office, but unconscious sympathy for weaker and defenseless people is born in Nikitin's soul: a sick child, a young exhausted mother, an invalid with a crutch, who are also waiting for their turn.

In addition, the host party is obliged to notify the insurance service and the Labor Inspectorate of the accident. In some cases, documents are also sent to the prosecutor's office.

In practice, a situation may occur when a worker is sent to perform certain tasks, but acts independently. That is, for the duration of a business trip, he is not “attached” to another enterprise, but performs the necessary actions, representing exclusively the interests of his employer. For example, an employee of the company is sent on a business trip to sign an agreement or draw up other documents.

In this case, the obligation to conduct an investigation rests with his employer. At the same time, the commission often includes persons responsible for the place where the accident occurred.

Separately, it is necessary to consider foreign business trips. If an appropriate agreement is signed with the country to which the employee was sent (for example, Abkhazia, Kazakhstan, Belarus), then the head of the host organization is obliged to conduct an investigation, regardless of the circumstances of the emergency. In other countries, the verification process may differ, and in some cases, a court decision may be required for recognition of an injury at work.

Injury on a business trip - industrial or domestic?

When an employee of an enterprise receives an injury resulting in temporary disability, the employer, in accordance with Article 183 of the Labor Code of the Russian Federation, is obliged to pay benefits to the employee in the manner prescribed by current legislation. In this case, the amount of payments is calculated in accordance with the rules established in Regulation No. 13-6 “On the procedure for providing benefits for state social insurance” dated 12.11.84.

At the same time, if the injury was received in the course of the performance by the employee of his duties, including on a business trip, then the procedure for making payments provided for in this case is enshrined in clause 16 of Instruction No. 62 of 04/07/1988.

It should be borne in mind that the period of temporary disability is not included in the business trip, and upon its completion, the employee must provide the employer with a sick leave or other supporting document.

The very concept of work injury as such is not used in current legislation. Article 227 of the Labor Code of the Russian Federation establishes the procedure for carrying out the necessary actions in the event of an accident and a list of incidents subject to mandatory investigation. These include injuries received:

  • During the working day, while the employee is at the enterprise, including during breaks and when performing other actions provided for by the internal labor regulations of the organization.
  • During a trip to the place of performance of labor duties, including on official or personal vehicles, as well as on foot. This rule also applies to trips by order of the head of the enterprise, which include a business trip.
  • When implementing labor activity shift methods, including during the period of rest between shifts, etc.
  • When performing other actions that do not contradict the law and are performed in accordance with the employment contract with the employer and in his interests. The norm also applies to work related to the prevention of accidents and other emergencies, as well as the elimination of their consequences.

The key point in the classification of injuries is to determine their nature. Often it is performed by the attending physician and, in accordance with clause 2.1 of the Instruction of the Ministry of Health No. 206 and the Decree of the FSS of the Russian Federation No. 21 of 10/19/1994, is noted in the temporary disability sheet. The worker, for his part, should promptly notify the doctor of the circumstances of the injury. If at that moment the employee was on a business trip, this must also be reported.

For example, if I slip on an icy staircase while on a business trip, how will my injuries be classified? According to Article 5 of the Federal Law No. 125-FZ on 07/24/1998. insured events include emergencies that occurred on the territory of the employer and outside it, in the process of traveling to the place of fulfillment of the duties assigned to the employee and returning back. Thus, receiving such injuries during a business trip should be classified as an occupational injury.

On the other hand, if the temporary disability of an employee was caused by the commission of illegal actions by him or with other actions not related to the performance of the labor tasks assigned to him, then it is recognized as domestic. At the same time, payment sick leave is made at the expense of the FSS and in the amount - proportional seniority worker.

The procedure for fixing and registering an industrial injury during a business trip

Nobody is immune from an accident. It can happen both at home and at work or on a business trip. But during a business trip, an employee may find himself face-to-face with a problem, since the actions necessary to record and document a work injury must be carried out by the employer. Therefore, it is important to notify the employer or the management of the organization where the employee temporarily works about the incident in a timely manner.

The investigation of an accident at work is carried out in accordance with the Decree of the Government of the Russian Federation No. 73 dated 10.24.2002. To do this, it is necessary to create a special commission, the composition of which depends on the circumstances of the injury. The location of the employee is also taken into account.

If the employee worked on the territory of the counterparty enterprise, then the management of this company must organize an investigation at its own expense. Also in this case, a representative of the injured employee's employer is also invited to the commission. However, its absence is not a basis for canceling or postponing the necessary actions.

If the seconded employee performed work solely in the interests of his enterprise, then the organization of the investigation is entrusted to the employer, and a representative of the enterprise where the worker was temporarily located is invited to the commission.

Regarding the execution of documents, the filling of which is necessary when recording and investigating an accident at work, the following is carried out:

  • Making an entry in the Register of registration of the National Assembly form No. 9, in accordance with part 1 of article 230.1 of the Labor Code of the Russian Federation;
  • Issuance of an order for the appointment of a special commissions for the investigation of the National Assembly;
  • Preparation and submission of a written notification of the NA to the FSS;
  • Registration of the act of form No. H-1.

The act is accompanied by evidence that was collected during the investigation, including photo and video materials. Copies of documents are sent to the Labor Inspectorate and the local branch of the FSS. If necessary, the materials are also transferred to the prosecutor's office within 3 days from the moment the investigation is completed. If the accident occurred with a travel employee, then copies are sent to the employer of this employee.
